TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, PERCEPTIVE ANALYTICS AND ITS OFFICERS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP, INCLUDING BUT NOT LIMITED TO INVESTMENT LOSSES, LOSS OF PROFITS, OR LOSS OF DATA.
Our total aggregate liability for any claim arising from your use of the App shall not exceed the amount you paid to us in the twelve months preceding the claim, or USD 100, whichever is greater.

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Delaware.
